hi i have a 125 sq.ft. room in pagdi system chawl
i am not residing there. now i came to know that landlord have decided to redevelope the land and he said he cannot grant me a room coz i use 125 sq.ft. and there will be no 125 sq.ft. room can be made in new building. i just want to know 1) how much are should i get ? 2) do i have to pay him anything 3) if things dont workout what are my legal options? please help me

Dear Sir / Madam,
1) A tenant is entitled to minimum 10% additional area from the carpet area he presently occupies in case of redevelopment.
2) You may request your landlord if you are keen to purchase additional area, but you will have to pay the agreed price for the same.
3) If the entire building premises is tenanted and 70% tenants have already consented to the redevelopment by the landlord, you have little choice but to agree along with the others. Else, you are free to surrender the tenancy back to the landlord an an agreed price.

Since it is a small area either you can settle with the landlord for some compensation for surrendering the area or else ask your landlord to provide you extra space at extra cost.
All depends on what you and landlord agree upon.
