Legal Question in Real Estate Law in India
Once, advance and part payment has been accepted, how come the contract can be canceled, unilaterally by the seller? Because part payment, completes a portion of the obligation on buyers part. And as such the seller has to give notice for compliance, and then after completion of the notice period can send notice for cancellation. In any case notice for cancellation can not be sent at the first instance. If I am right, please give your views, in legal terms.

it is depend upon the terms of the contract. if you are willing perform your part within time then you can send a notice if he disobey then you can send a notice claiming compensation or if the contract is registered then you can go to the court for enforcement
