advise.
My lawyer has informed me that if I PURCHASE IMMOVABLE PROPERTY 4 my benefits but IN THE NAME OF MY son from my own money & if I myself takes the possession of the same The transation will b a sham transation & not a benami transation? Is that a correct advise in view of the judgement in AIR 1989 KERALA 317.?

In case of freehold property, it may not be a sham transaction.

It will not be a sham transaction. You are legally entitled to purchase property in the name of your son out of your own funds.
