Legal Question in Real Estate Law in

Agreement of my flat on Ghodbunder Road took place on 23rd Dec, 2008. Registration done on 23rd dec. stamp duty paid on 20th dec , 2008. Now on final posession builder asking for VAT amount to be deposited as FD in builders name whereas he is not giving this in writing and neither the pre-posession letter mentiones anything on this amount. as per posession letter payment i have paid everything. Now he is holding my posession and not replying to my letters. I have written to him that i have paid all what was written in your pre posession letter but he is stil holding posession. Please guide why he is doing like this and what i need to do. I have sent him three Registered notice but no reply. The amount of FD is app rs 14000/-.

pay the amount of vat and take possession first than file a case for refund from the builder for the excess amount charged
