Legal Question in Real Estate Law in India
we have a an ancestral chawl house on pagadi system where my bachelor mamaji of age 64 resides & its home to us since almost 100 years now. Since past 26 years the owner has stopped taking rent from the 10 families residing in this chawl after they united to form a society. Can we still form a society after all these years now & can we approach any builder for redevelopment since its a prime location in mumbai? How safe is our tenancy rights? What proceduce should we follow to protect our property right since the house is not in my uncle's name but he has the electricity bill on his name since 36 years. Please guide us. Tender the rent by Money Order and preserve returned Money Order, if same are not accepted. Continue this either monthly or quarterly.
