We have own a flat in a appartment now builder says that the tarrese is his own hands and he will use it as he wishes. like as to give on lease or for Tower or use FSI and TDR as he wishes.
Is It Leagle?
What are the rules and give me the links.
What should we do now?

Rights of Roof is to the upper floor owners. But if there is any condition in the sale deed then give the detail but you can restrain. (Plz verify conditions like any way of roof etc.)

May depend upon your contract. You may like to meet a lawyer with your documents for appropriate opinion.

Check the terms of the agreement as also Declaration registered under section 2 of the Maharashtra Ownership Flats Act.
If it is contrary to the law, approach court for appropriate reliefs.
