Legal Question in Real Estate Law in India
as asked the question earlier i have purchased a flat for rs.5 lacs and paid rs 1.50 lacs and made registered banakhat in which it is clearly mentioned that i have to pay the balance in three year and after paying all the money if the seller does not executed sale deed i have to do it through courtin my favour. As i have paid almost all the money CASH at regular intervals. Due to rise in the price of the said property (Market value rs.15.00 lacs today)he neither he is willing to execute sale deed nor he gives me possession of the flats. what can I do now. I have also told him that i will go to court but he said U can go to court. Here I mention you that all the original documents of his property are lying with me.and he want zerox copies of the orginal documents and registered banakhat. 1.Can I give him. 2.The the banakhat is expired on 3.3.2013. and FINALLY WHAT SHOULD I DO

In a matter like this, you need to have a complete strategy ready before taking any step.
Consult an experienced senior civil lawyer and proceed further.
going to court is the only option left with you if he is not willing to execute that ......
File specific performance suit against the seller.
