Kindly tell whether a benami transation entered in 1960 will attract the provisions of'' prohibition of benami transation act 1988'' if a defence is raised in a suit filed in 2007?QUOTE THE RELEVANT CASE LAW WITH YOUR PROFECTIONAL CHARGES.

Well it depands on the previous movements been made but yes they will attract the provisions. please contact personally for the relevant case law and later on professional charges can be discussed.

In a suit instituted in 2007, defence of benami is not available. Provisions of Act are quite clear on this.
