is it necessary?

IS it necessary that the Benamidar must be in possession of the property before he can suceed in a suit of possession & if he is not in possession OF THE PROPERTY & the possession is actually in hands of the real owner( one who has put one's money for the purchase of the property) Benamidar will not succeed because Word ''HELD BENAMI'' used in sec. 4 of the benami act 1988 means that the Benamidar must hold the property i.e. must be in possession of the property if sec. 4 of the act of 1988 has to be applied for the benefit of the Benamidar otherwise NOT.
