Legal Question in Real Estate Law in India
hi, i have booked flat in oct. 2007.My builder is demanding Vat tax that is 4%of agreement amount.
High court declared interim stay to collect vat from consumer.
As i didnt pay Vat tax yet, builder is not giving me possession letter and keys of my flat.
but he is allowing me to stay at same flat.
in such case what shall i do?

Most of the builders are taking VAT and service tax in anticipation of adverse orders.
You can enter into an elaborate agreement and keep the amount of VAT or like taxes in a Bank FD or such other method ensuring availability of that amount to builder as and when such tax is finally recovered.
