Legal Question in Real Estate Law in India
I booked a flat in Pune on 31/5/09.The agreement was executed on 7/11/09.In the agreement the "Possession Date" was December 2010.Till now I have paid abt 75% of the cost.
The flat is still not complete(9/4/2012).The builder says it will take another 6 months to complete the flat.The entire agreement is one sided and tilted towards builder.The builder days he will refund the amount with interest of 9%.But the difference in property rates on 31/5/09 and now is huge;cancelling the said booked flat will be more economic ruinous.My situation is like cought beteween deep sea and devil.Can I legally ask the bulder for compensation ?(I am living in rental place a more than 27 months from promised date of possession.

you can ask for specific performance (possession) or money back with reasonable interest (which court allows btw 12-18%). Getting money back will not be the wise idea, so wait for some more days
