Legal Question in Real Estate Law in India
I had booked a flat in sep'2008 from a builder in 2008 and got possession.I had given a cheque for 5% of registered amount of flat as security for VAT to be paid in future .The cheque was signed and amount was filled but undated.Now builder has paid VAT and is asking to pay us.The amount is less than the cheque was given.We are not satisfied by builder's calculation of VAT hence asking to rectify it but he is thretening to deposit the undated cheque.What to do? is there a case under sec 138 of NIA.pl help
