Legal Question in Real Estate Law in India

I bought a residential plot last year in oct. When in Apr 2009 i got the surface cleaned cutting shrubs etc for construction of house, the plot actually measured about 6 sq yards less than dimensions mentioned in the papers of registry and subsequent mutation.Even though a stone demarcation boundry was there, it was not mentioned in the registry.When i contacted the seller he kept on promising refund of the difference amount which he never did. Finally i sent him a legal notice through my lawyer.In response his lawyer says that his client had given me possesion of plot as per dimension stated in papers only and he is no longer responsible for any deviation.His lawyer has also warned me against trying to seek any legal remedy against his client.I would like to know if i have any legal options available including a consumer court case or FIR in police and what is the best option for me.

No offence made out.

Consumer court will have jurisdiction if your vendor was a builder or developer engaged in purchase/sale of plots.

Only remedy is to approach civil court with appropriate suit.
