Legal Question in Real Estate Law in India
Actually builder has his own land & he developed it into Apartment & sell falt to all.But he says only flat can be sale as per legal rule not parking .So he made registered aggrement of flat & parking alloted to me on letter head like other flat owners .This allotment letter of praking does sufficient to show it is my own part of property.nad really as per high court parking cant be sellable ?

Dont compare High Court parking with a builder constructed parking. The parking must be part of ur registerd document...
When did high court said parking is not sell able......there is no value of builders letter head.... make the parking area also registered....
Builder has no right to sell the common amenities, as per Supreme Court ruling, and parking forms part of the Common Amenities.
As per SC ruling under MOFA, parking can not be sold by a promoter/developer.
