Legal Question in Real Estate Law in India

one of the builder in nashik city,sold one row house to me, he was not land owner but was a gpa holder to devlope a plot,& counstruct residencial row houses.he made sale did & registered it in sub registrar office of state govt,without mentining to gpa papers issued by land owner, now when I went to record that sale did document in talathi office, He refused to accept it by saying that the GPA issued by land owner of concerning plot is not mentioned in sale did due to that it can not be considerd to accept for registration to issue 7/12 noting in my name, now I request you to advice me to take further action to register it in his office to get 7/12 notifying for my legal safty.

Check Sale Deed, generally copy of GAP is annexed thereto. Alternatively, in the set of documents provided to you by builder, copy of GPA would be there. Otherwise, you can always take a copy from builder.

In any case Talathi has no concern with this issue. As per law, he has to issue notices to all the parties to the Sale Deed and if nobody object, his superiors would certify the mutation.
