Legal Question in Real Estate Law in India
I had cancelled my agreement post expiry of the tenure of payment for sale for my house with my buyer after he started harassing me and tried renegotiating the price under false context of less area. The buyer went on and filed a complaint with the police to harass me further. Post that I went to the police to give all documentary evidence for his false case and to avoid further harassment took an ABA as well. the police did not register any case against me. Now this gentleman is writing to my builder to give NOC so that he can avail the loan and repay me. I dont intend to sell him the flat and he has not contested me in any court of law for any dispute nor he has contested my termination notice ...all he is trying to do is to create nuisance so that I give in my property to him as lesser price than agreed as per the registered agreement. I had requested him number of times in writing and have even mentioned in the termination letter to collect his earnest money and sign the cancellation deed. he is not coming to do the same. Please suggest how I can unilaterally cancel the agreement?

this is a civil dispute and how can he file a criminal case. u need to send all the papers viz f.i.r. and suit papers so that i am in a position to advice you better.
