Legal Question in Real Estate Law in India

Capital gain on property

I want to know how capital gain is levied on a property being sold. I'm buying a flat which is under construction and will get possession only after 1year or so. Flat's registration is done and I've index-2 with me.

What I want to know is whats the earliest that I can sell this flat when capital gain is not levied on the sell.

Regards,

- B
