car parking
sir i have purchased a flat at mulund mumbai in year 2004, the builder has sold to 45 members of our society stilt parking which is open from all sides means it is covered but not enclosed nor having a shutter or a door.
the parking area sold is having a agreement value of Rs 5000/- on stamp paper of Rs100/- and has not been registered.
sir few of our member want to take action against the members who have purchased the parking if the purchase of parking is illegal. sir pls give your opinion and guidance on this issue.

Please consult personally with the documents being made by the builder as there is no sale or purchase of the parking.

There is no purchase or sale of parking. However, exclusive user of parking granted to occupier of particular flat/unit.

You need to check legality or otherwise of the documents made by the builder. Consult your lawyer with all details/documents.
