Legal Question in Real Estate Law in India

Caveat on Property

I purchased an appt on my wife name 20 years ago with my own earnings. Now our relationship is getting sour. I am afraid that she may give this flat to her brother instead of my children. Can my children and myself register a caveat on this property claiming our rights? This is for only preventing her from passing /selling the property to anyone else except us, not to prevent her from living in it.

Re: Caveat on Property

Caveat will only entitle you to be heard in the event of any suit or proceeding instituted. Caveat does not prevent anybody from selling the property. You need to file a suit for the same and get injunction.
