Charges for NOC letter from builder

Hi

I need to urgently sell a flat that I bought in 2006 and have a buyer. Since the builder hasnt yet registered the society, I needed to approach him for an NOC. He says, I will have to pay him Rs. 50,000 for that.

A relative of mine who has studied law told me that even a society can only charge 0.5% of the sale price upto a max of Rs. 25000 and a builder has no right to charge any fees. Is that right ?

Kindly advise.

BTW, I am selling the flat for Rs. 17,00,000. The flat is in Pune, Maharashtra, India.

Your relative is right.

Builder can not charge any transfer charges.

In fact, demand of any money by builder apart from what has been stated in the agreement is an offence.
