Legal Question in Real Estate Law in India
CHS Question
Dear Sir,
I have ground floor flat in a co-
operative society. With the
development of the neighboring
area, this CHS comes in the
commercial area of the suburb. I
would like to convert this flat into a
commercial area wherein a
shop/showroom can be opened or
can be rented out as an office
space on commercial terms. I had
given the request to the society
asking permission to use my flat as
a commercial. However, society
members have rejected my request.
I was ready to pay to the society
some amount which can be used for
society repairs which are required
to be carried out urgently.
I would like to seek your help in
this regard. Is it possible to convert
the flat in commercial area or rent it
out to a office on commercial terms?
If the society does not give the
permission, then can I get the
permission from BMC and start
using the flat as commercial?
Appreciate your reply.
Thanks

Re: CHS Question
In CHS, Society is the owner. If a member breach the bye-laws or other conditions, he is liable to be expelled.
Re: CHS Question
Th society's laws are ultimate and you can not break them.
Re: CHS Question
no as the society is a residential one u cannot change the status of the society for more information log on to www.angellfire.com/folk/indianlaws or mail at [email protected]
Re: CHS Question
The Society may not be allowed to grant you such permission. You may approach the BMC and find out if you could be permitted to convert your residence for commercial purposes.
