Claim the land back

We have a 4 guntha land in a registered society which was given to a builder. We made an agreement that till Dec-08 he would give us four 1-BHKs with parking space in the building he would construct. The builder has not built anything on our land still. Would a mere notice through a lawyer about agreement being void since the period has lapsed be enough to claim it back? How do we go about it and how long will the procedure take?

To give prorper advice, we need to see the copy of agreement. In certian cases you can revoke the agreement by notice also.

Lapsing of time would not make an agreement void.

If you have delivered possession of land to the builder and also made a registered agreement with him, then proper manner would be to have a duly registered cancellation made or approach court.
