Clearification to the benami act of 1988

If the possession is not with the benamidar(who is the son of the real owner)& IN FACT THE POSSESSION IS WITH THE HEIRS OF THE REAL OWNER,sec.4 of the benami act 1988 will not have any implication? Did you mean to say that benamidar is son of real owner and he is not heir??
