Legal Question in Real Estate Law in India

under collaboration agreement builder has supposed to handover the built up physical possession of our house in Delhi during Jan 2012 but till date he is not willing though the house is almost complete. the builder is also not paying us the rent of hired accommodation as well as the penalty imposed in the collaboration agreement. we have requested him by post also but nothing fruitful happened in our favor. what is the pros and cons of a legal notice if sent to him.pl advise and tell the other remedy. thanks

You may file a suit for specific performance and recovery against the builder.
