For institution a suit, there is no provision to condone dealy. Dealy can be condoned only for appeals or other proceedings.

for a new suit - delay will not arise!

but for case that was already dismissed for default or appeal time lapse - 10 years dely is a huge time. may or may not be condoned - it all depends upon the reason and proof you provide to the court and the judge who hears the case! S.151 cpc
