Dear friend,

As per the provisions of Indian contract Act �Every person is competent to contract who is of the age of majority according to law to which he is subject, and who is of sound mind, and is not disqualified from contracting by law to which he is subject�

Therefore the following persons are incompetent to contract :

a) minors

b) person of unsound mind, and

c) persons disqualified by law to which they are subject

According to Indian Contract Act. Section 11 states as follows.

"EVERY PERSON IS COMPETENT TO CONTRACT WHO IS OF THE AGE OF MAJORITY ACCORDING TO THE LAW TO WHICH HE IS SUBJECT AND WHO IS OF SOUND MIND AND IS NOT DISQUALIFIED FROM CONTRACTING BY ANY LAW TO WHICH HE IS SUBJECT."

from the above it is clear that every person who is major can contract provided he is not disqualified can enter into contract. To be a Major he is to be 21years for male and 18 years for female.

Every person who has attained the age of majority, is of sound mind and is not disqualified from contracting by any law to which he/she is subject, is competent to contract.The age of majority is 18 years under the Indian Majority Act, 1875. In case of a minor of whose property the superintendence is assumed by a Court of Wards before the minor has attained the age of 18 years, the age of majority shall be deemed to have been attained at the age of 21 years.
