Legal Question in Real Estate Law in India
Court has asked to probate will of deceasedDeceased has expired 4-5 years back.
Will has not been probated by plaintiff and it has been over 2 years.
(a) Probate has to be done with in three years of death of deceased.
(b) Why plaintiff has not probated the will yet ?
(c) Can case be filed afresh if plaintiff not taking any action?
