Legal Question in Real Estate Law in India

Cousin has filed a partition suit against 3 brothers and 2 brothers have appeared through their lawyers. Myself an ex parte. If and when the case is decided, to get my share do I have to approach the court again or the court will allocate my share. Any clarification in this matter is appreciated.

If you are exparte then court may award one share or they may not. So it depends upon the court and the evidences brought in by the other brothers. so need to check the order from court for proceeding further.

It is not a favourable condition.

Approach court for court's grant to join again if case is at initial stage with strong reason to not be present on time.

Otherwise, your share depends upon other parties arguments and court discretion.

You have to keep yourself updated and apply for the copy of order when it will be passed.
