DCR 33(7) in Mumbai

Dear Sir,

I have a query.

I am a small time tax practitioner.

I am a tenant of a office room measuring about 100 sq. ft. in a building in main mumbai for the last 20 years.

The room is on the first floor on which 70% rooms are residential and 30% rooms are office.

The building is now under redevelopment under DCR 33(7) talks, reaching final stage soon.

Please guide me as to how much minimum area should I get in the new building wrt the existing laws.

What care should I exercise to protect my interest?

Please advise me.

If redevelopment is by Govt/MAHADA, then you have to go by the scheme sanctioned in this behalf. Check scheme for the details.

If redevelopment is by private developer, your area would depend on how you bargain the deal.

Dear Querist,

As per latest judgement of the S.C the unlimited FSI can be used in old buiding at the time for redevelopment if such buiding is old more than 40 years old and atleast 1:4 FSI can be used by builder for the redevelopment of your building. And if builder will get such huge benefit of course the tenants are entitle to get extra atleast 20-25% ore more carpet area. In any case the occupants should hire a lawyer to look after their rights and benefits they ought to get in redevelopmemt.Our law firm do take up redevelopment projects.we had already done few redevelopment projects . Some projects we are consultants for the Builders in others we are consultants for the Society . we do undertake the whole the projct like yours & give it to our reliable builders for redevelopment .In this way through proper legal channel your work would be done.
