Legal Question in Real Estate Law in India
Dear Sir / Madam,
I am staying in a pagdi system flat in Mahim, Mumbai which was purchased by my parents some 38 years back. In the same building my neighbour is planning to sell her flat and we are interested in buying the same. Our query is what is the percentage of Share we have to pay to the landlord, what are the documents required from the buyer, the seller and the landlord to legally close this deal. The flat is in the name of the wife, can she sell the house without the consent of her husband and will he be able to create any legal issue on this matter.

Pagdi system means change of tenancy with consent of owner. There is no purchase or sell.
All the terms in a Pagdi system are decided mutually and there is no percentage formula.
