Legal Question in Real Estate Law in India
Dear Sir,
I am from Andhra Pradesh, India. Our grand father brought a cultivation land and registered on his both daughters. His youngest daughter was my mother. we are two daughters and four sons.My Aunt had three daughters, no sons.According to the large family to his youngest daughter, he registered 2acres extra on her name. As we all settled in city, we, with the knowledge of my cousins given the land for third party for cultivation. (we had an oral agreement with third party, which will be in force till April 2011).The property is not yet devided among us till they expiry of our grand father and mothers.Now my cousins wants to look after the cultivation process of the whole land without our consent and threatening the third party, who is looking after the cultivation to withdraw from the agreement, and also demanding the share in that 2acres, which our grand father registered on my mother's name.In these circumstance what should we do? should we apply for a stay order? if so whats the procedure and within how many days we will grant stay order and how long it will be in force? how the second party will react? If they go to court for the share in that 2acres, how the out come of the judgement will be? Kindly be advised.
