Legal Question in Real Estate Law in India
Dear Sir/Madam,
I have purchased agriculture land in 2006 and made the agreement at the same time. In 7/12 sheet there were names of 4 brothers and 1 sister. In agreeement 4 brothers have signed and for signature of 1 sister they argued that as she is married the long time back and settled some where so need of her signature.
We are farming this land since 2006. Now when we applied to transfer names in 7/12 sheet that sister raised objection so that process is held up. Now we file a case on them arguing that we have paid money and having possession since last 4 yrs.
Now options available with me are
1. One of medeator from our society have taken up the matter and asking to settle issue But for that that sister is asking 2 lacs more should I accept it?
2. Fight the case as long as it runs.

Fighting might not give you any real relief.
With passage of time, prices of lands tend to increase.
Better to negotiate present demand to maximum possible less and get a registered deed from said sister.
since sister's name appears in 7/12, she has a right to object as she is owner of 1/5th land. There was no escape for you in 2006 from sister's signature. You fell into the trap of brothers. You must negotiate and settle with sister and get her deed executed and registered. You may include brothers to negotiate depending upon your consideration was for the total land or for brothers share only.
