Legal Question in Real Estate Law in India

Dear Sir,

My brother and his family are living in my flat in Mumbai. I allowed him to move in there as he had no where to go. There is no contrat or rent being paid. he is just living there. Now I find he is abusing the facilities and I want him to leave. The property is in my name. Please advise the best course of action to get him to leave.Thank-you for your reply in advance.

Your brothers status in your flat is of licensee and to get your flat vacated from him ,you have two options ,1) to file a suit for mandatory injunction or 2) to file a suit for possession against your brother.
