Legal Question in Real Estate Law in India

Dear Sir,

My father gave our flat on rent 20 months back to a tenant which we know from past few years. Now we need to sell this property so that we can buy a good one in Noida Extension, problem is that they are not vacating the place and from past 4 months they are saying they need time. I m sure they are in no mood of vacating my house. Please advice me what should I do to get rid of these tenant. We have signed 2 agreements of 11 months with them (their sign and acceptance is there). But the agreement is not registered in court. But every document of this property is under my father name.

Please advice what should I do?

What is the amount of rent ? If it is more than 3500 then send him a notice u/s 106 of TP act to vacate by giving him 15 days . And then file a suit for possession in the court. You will get your property vacated in a year or two .
