Legal Question in Real Estate Law in India
dear sir,
my father in law is partial. my husband has 1 elder brother and 1 younger sister all are married having 1 girl child each. we got married in 2007. our is love marriage they were happy with our marriage. after 1 year because of husband's elder brother's behaviour and arguments and as he is a drunker we took separate home and stay separately. my father in law was against our separation as my husband's elder brother dont have stable job my father-in law expected from us to provide financial assistant to him and stay together to avoid economic problem. we purchased flat before marriage only so we have to pay installments too. we told them this problem and also told them that we will not be able to stay under one roof just because we are unable to handle domestic violence every day with brother and his wife.but if you want you can come and stay with us.but they never come to stay. during my pregnancy and after delivery also they never came. they are just repeating only thing that staying separately is your decision so now dont expect help from us. hardly 2-3 times they visit our home.they are with my husband's brother even though he is not giving money my father in law is working after retirement to feed eleder son's family.in such situation i am worried if father in law make a will that after his death property belongs to elder son then we will not get anything which is wrong. dont you thing this will law is wrong. we are ready to take care of our in-laws but they are not ready and they are supporting his elder son only. dont you thing this is injustice to us. is there any law that we can challege our in laws will for property share. please advise me.
