Legal Question in Real Estate Law in India

Dear sir,

My property issue case was dismissed in the civil court 6 years back due to non attendance of my lawyer. Now both parties compromised and want to make a settlement through lok adalat. Can we both parties approach lok adalat directly without the consent of our lawyers, because now the other party lawyer is also not cooperating with our opponent party. ie., Can we both parties bypass their lawyers and approach lok adalat for final settlement.

Dear Tejomurthy,

There is no law which bars you from representing and arguing your case yourself in the Court of Law. Advocates / Lawyers only add valid inputs to substantiate your case. You have every right to actually participate and you should actually be present in the Court whenever your case is being heard; and the Court encourages this practice.

Yes .. you do not need the consent of your lawyers to directly approach the lok adalat for justice and settlement of the matter.

If suit is already dismissed, then nothing survives for Lok Adalat.

Pending matters are taken before Lok Adalat for amicable settlements.

Without a litigation - you cannot approach lok Adalat. In any event the lawyers have no role to play before lok Adalat.
