Legal Question in Real Estate Law in India
Dear sir,
Property is in father's & mother's name.
Mother expired leaving WILL in favor of her 2 daughters. WILL was probated. Society is delaying to transfer mother's 50% share in 2 daughter's names saying that they will do it in next Annual general Meeting. Father is very old & sick. Father has given P.O.A to 1 of his daughters to sell property. Father's & Mother's names are still in Share Certificate. Property is a flat in Mumbai.
My question is can both daughters sell parents property & get sale agreement registered without their names on the share Certificate still.
