Legal Question in Real Estate Law in India
Dear Sir,
Property in favour of my grandfather which has been transfered to Sale deed and has not registered yet. Grandfather having two son . Thrice has been expired . Elder son having two son, his eldest one is at high Government position as well as sufficient wealth and knowledge he wanted to own maximum part of property by his position and wealth.
Younger son of Grandfather having 5 children along daughter and me.Property still in favour of Grandfather. Please suggest the way how I can save ourself by securing our legal property.

What i have understood from your question is that the property is still in your grand fathers name and both his son s have died leaving behind two sons from the eldest son and 5 children from the youngest son tha includes you as well. Is your grand father still alive ?please clarify .

The property of the Grand Father would devolve upon the Grand children in this manner . 1) 50% of the property of the grand father would fall on the eldest son and the same would fall on his two children .and 2) the rest 50% of the property would fall on the youngest son of the grand father and the same 50% property would get divided amongst his 5 children . The best way to get the property partitioned would be to file a partition suit in the court.

Hi Sanjay Sir,
In continuation above trail mail please advise if I am being residing at my portion since 20 years which my grandfather alloted verbally( having no proof) how can my uncle eldest son can harm legally and how can we remain at same portion harmless. Please suggest all the positive factors so as live confortability .
In my parental generation , my mother left if any favouritism come to her regarding property .
