Legal Question in Real Estate Law in India
Dear Sir,
There are three brothers and two sisters in the family of my father. We were having disputes with my grandfather and my uncles. So we got seperated in 1995 and in 1997 we were forced to leave the house of my grandfather in chandigarh. We got only one plot in panchkula which was in the name of my father under the guardianship of my grandmother who was missing since 1996. We had sold the plot in 1997 and purchase a built up house in chandigarh.
At the time of division there was simple letter signed by my father, grandfather, uncle and the neighbours saying that my father will only get the plot and he has no share in the rest of the property.
Sir, now my grandfather had died. My one Bua(my father's sister) is mentally retarded and other bua is married. My one uncle is still unmarried. My youngest uncle is taking care of all the property and my mentally retarded bua and my unmarried uncle is also living with him.
But we know that after there death my uncle will hold the property.
Is there any chance of my father getting any further share in property being the elder brother.
We are one brother and one sister and i am married and having one girl child.
Please advice me.

the partition document needs to be perused before anything can be said about the partition. in case the document executed does not hold water, you may file the suit for partition.
