Legal Question in Real Estate Law in India

Dear Sir,

To my mind if the advertising Pamphlet mentions all these issues for ex., Swimming pool , Club house , Joggers Park, but the builder may have not mentioned this in the individual agreements to the buyers. Can he drag his feet on the provisioning of this facilities. Inthat case is the buyer justified in witholding these instalments till this amenities are providede?

If something has not been provided in an agreement, which inveriably executed after publication of pamplet, then that may amount to waiver.

If major of owners get together and demand as per pamphlets then there are chances that builder has to construct and provide all the facilities. you have to approach consumer court.
