Legal Question in Real Estate Law in India

Dear Team,

I purchased few cent of land in my and wifes name.While we purchased the boundries where cleared marked with stones, but now after one year when i went to construct boundry wall i see no boundry stones , seems all removed by my neighbour and it seems my neighbour had taken few cent into his . Am totally confused how to sort out this issue.Kindly guide me how to go ahead

Hi

First you need to be sure, if land has actually be encroached by your neighbour. You should get your admeasured privately. And then if there is encroachment, then you shall apply to office of Land Records to demarcate the lands. And if there is dispute, then you will have to file civil suit for removal of encroachment.

Hello,

Immediately restructure your plot's boundary except near the area you believe it is encroached.

Simultaneously get your land measured and apply for land records.

In case of dispute, send a legal notice.

File a civil suit, whereas try to solve the problem with the help of local associations and political guidance during a mediation. (as civil suit can consume your substantial time)
