Delhi me mother ke naam ek property hai jisme hum 3 brothers ka batwara hona tha. Mother

illeterate hai aur uski age around 80 years hai. Meri badi bhabhi (widow) ne hume inform kiye bina mother ko behkaakar us property me se jyada portion ki registry apne naam karwa li jiska pata ham dono brother ko ek mahine baad pata laga. Bhabhi ne jo registry karwai hai usme gift/partition deed na karwakar Sale Deed karwayee hai aur registry me likha gaya hai ki humne saara paisa advance me aur cash me diya hai aur ab koi dues baaki nahi hai. Jabki koi paisa nahi diya gaya hai. Jis portion ki registry karwayee gayee hai uska market rate Rs.1.5 Crore hai. Uske baad bhabhi ne wo property chupchaap sell kar di. Kya Sale deed karwana legal hai jabki yaha hamare ghar ka batwara tha? Kya iske liye hum court me case kar sakte hai? hum dono bhai ka abhi tak is property me se batwara nahi hua hai. Please guide me

Your problem is very intricate as i would be needing lot of answers from you with regard to questions which i would like to ask you before giving you my legal advice. Prima facie you can challenge the sale deed or the gift deed executed in your bhabhis name by your mother.

aap partition ka suit daal sakte hai aur apna right court main prove kar sakte hai.
