Legal Question in Real Estate Law in India

What is difference between ancestral property and self acquired property. If a grandfather has bought property by his self earning than can a father self acquires the property and sell it to any one without getting known to his son. Does son have right on property and avail stay even after the sale of property by father.

Kindly help us or else we will be in trouble.

My father is misleaded by some antisocial elements and got registered sale deed documents from him after the death of my grand father now we are in trouble as we dont have good relations with our father although we stay together

In sale deed he has mentioned that he is only son of my grandfather and that he dont have anyone else ie we sons. But buyer was knowing the fact that there are sons who are living in this property. How can we fight this case or we will be on road. my father has selfish motive, he got the money and wants to get married again living us like a begger. My father had no role in upbringing us. Everything was done by my grand parents.

you may file a suit for cancellation of sale deed allegedly executed by your father on the grounds that the property is HUF and cannot be sold by the father.

Mr.Gupta is absolutely wrong and misleading . I have already answered this in your earlier question on Lawguru. I am repeating here for your benefit . The property of grand father who has died intestate automatically goes to his son and your father has become the self acquired owner of the property. Your father can do anything with same .You have no rights in the property.
