Legal Question in Real Estate Law in India
Dispute over family property
My father built a very huge bunglow in a very posh location in South Delhi. When he was building the house I contributed Rs.58, 000 back in 1978, a huge
sum of money at that time. And no one else contributed this much of amount. We were 6 brothers and 5 sisters. Now only 4 brothers and 5 sisters are
alive. No will was made by my father. Now a few of us want to sell the property and the rest don't want to sell it at all because of personal benifits.
The ones who want to sell the property need some legal assistance to file a case.
And I also want to know what is the possibility of myself getting my share and selling it. What is the sare of the property that a I will be getting since i have contributed the maximum amount in building the house?

Re: Dispute over family property
Irrespective of the contribution made in the year 1978, you will be entitled to share equally with other legal heirs.
You may institute a civil suit for partition of the property and may also sell your undivided share.
Re: Dispute over family property
irrespective of the contribution made by you in the construction of the house, all the brothers and sisters will have an equal share in the property. you may institute a civil suit for parttion and then sell your undivided share.
Re: Dispute over family property
All the legal heirs would have equal share, if property is self acquired.
In respect of dwelling house, though one of the co-owners/heirs can sale his/her undivided share, the purchaser will not be able to get that share separated.
Proper manner would be to have the shares separated and then sale.
