Escalation charges to co-operative society

We have purchased a house in group housing scheme by co-operative society in Delhi. The society is asking us to pay the escalation charges, please advise any legal remedy.

A society is comprised of members only and therefore, the financial burden of escalation, if any, has to be shared by the members proportionately. The matter should be better decided in the meeting of MC or AGM. There may hardly be any legal remedy to avoid such a liability.

Kindly read Bye-Laws and Local Act governing Co-op Societies.

Normally, a society can ask for transfer charges in case of a transfer. The amount is specified by law.
