Legal Question in Real Estate Law in India
evicting relative from property
NRI parents own a flat in Maharashtra. NRI's sister was property caretakers for past 7 years while NRIs were abroad. All expenses, utilities, tax, etc were paid by the NRIs for 7 years and there are no written agreements with the caretakers, including any rental agreements. Now the NRIs wish to sell the flat due to poor health, but the elderly sister and husband refuse to leave. Do the NRIs have any rights to sell, rent, dispose of their property thru legal eviction of the occupants? What would be the quickest way to make the occupants vacate?
