How should a prayer in a suit for eviction of licencee be framed? should it be a prayer for mandatory injunction, of should it be for recovery of possession? Is it necessary tht there should be written communication of revocation of licence?

Re: Eviction of licence

The prayer in the petition should include both for mandatory injunction not to disturb anything or utilise for the purpose given and also a prayer for ejection of the premises, besides you have to send notice giving 30 days time if nothing else is provided in the Agreement entered into between the parties.

Re: Eviction of licence

Yes, a license must be terminated by a written notice. If no term of such notice is provided in the license agreement, a 30 days clea notice should be given.

The prayer should include both for mandatory injunction as well as for eviction.
