Exceptions to benami act 1988

Consideration for the purchase of plot & construction paid by father (real owner)but the property was purchased in the name of son..(benamidar). Real owner since died.Benamidar is NOT IN POSSESSION.Possession is with the other legal heirs.The specific question is whether the provisions of the act of 1988 DO NOT APPLY in view of AIR1989 KERALA 317;(1995) 2scc 630 & (1996) 4 SCC 490(at para 4)? sale deed being of the year earlier than the year of passing of the act.
