Legal Question in Real Estate Law in India

We are a family of four, mother, two married sons and one married daughter. My mother has inherited a small house from her mother and it has been verbally agreed many years earlier that it should be given to the daughter - that is my sister through a 'Will'. Our father is no more and we are trying to do the partition of fathers assets equally into 4 parts. But because the daughter is already getting mothers house, one of the sons say that the daughter should get less compensating for the house. But my mother says it is different (and it is hers)and cannot be included in the current partition. My mother wants fathers asset to be divided equally, where as the son does not accept that. What should we do?
