Legal Question in Real Estate Law in India
My father was an adopted son and he died in the year 1996. We are four daughters and one son to him. To our knowledge he did not execute any will. We waited till now hoping my brother to share the properties earned by my father as well the ancestral property. But now my brother says my father executed a will giving entire property to him and hence no share for us. He started selling the properties one by one without our consent and without giving us a share. During my father's lifetime the terms were not so good between our parents and my brother and his wife. But after my mother's death my brother looked after my father for about two years till his death. My father was not unhappy with any of our sisters and me. So we doubt the genuineness of the will said to have been executed. Are we eligible for our share in our father's property? How to check to genuineness of the will said to have been executed by my father Even if the will is genuine, is it legal for my father to execute a will for the ancestral property entirely to my brother without any share to any of the daughters? Please clarify and advise.
